1. Definitions

means you (consumer/customer), any person who visits our sites and/or registers to use our services, it also refers to any authorized person on your account(s) and anyone who deals with us on your behalf including attorneys under a Power of Attorney, legal executors, personal representatives, beneficiaries and trustees.

PesaWay is a licensed PSP that simplifies payments for businesses and individuals globally. Our vision is to empower businesses and people globally through innovative, reliable, and seamless digital technologies.

This Privacy Statement has been developed to explain how we process your Personal Data, when you visit our Sites or use our Services. It also outlines your rights as a data subject and details on how you can reach us with privacy-related inquiries. This privacy statement does not apply to any third-party websites that may be linked to PesaWay including the sites and services of other PesaWay users.

This privacy statement should be read together with the Terms and Conditions of Use for our products and services. Where there is a conflict, this privacy statement will prevail.

3. Personal Data We Collect

PesaWay collects and uses certain personal data in order to operate and provide you with access to the services as permitted by the applicable data protection laws and regulations in the countries we operate. This includes without limitation information that you provide to us and information that we collect automatically when you visit or interact with our Services and or sites. In limited cases, we get information that is in the public domain.

3.1. Information You Provide to Us

When you register to use our Services, we collect Personal Data that you voluntarily provide to us. This information includes, without limitation: business name, business sites, business owners details, your name, gender, date of birth, your email addresses, telephone numbers, financial information, education, credit reference, next of kin and other contact details; biographical information; audio and visual data, social media information; submissions to our customer service & experience whether by phone, face-to-face, e-mail or other means of communication; feedback, including those of market research/surveys, on our website, social media pages or mobile app; online preferences, such as alerts.

PesaWay may record and monitor conversations made through our official lines, online meetings, letters, e-mails, online chats or other forms of communication in order to identify a customer, authenticate instructions, improve customer experience and product offering and manage risks.

You also voluntarily provide to us your personal data when you:

  • Apply for an employment
  • Visit our offices
  • Attend a PesaWay event
  • Participate in a survey

Your information is also provided to us when you are identified as a next of kin, family or a referee.

3.2. Information We Automatically Collect

3.2.1. Device and Connection Information

We collect device and connection-specific information when you install, access, or use our Services. This includes and not limited to information like hardware model, operating system information, app version, browser information, connection information including phone number, mobile operator or ISP, language, time zone, IP, device operations information, and identifiers.

When you use PesaWay WIFI for guests and visitors, we collect email IDs and will provide username and password. We record the device address and also log traffic information in the form of sites visited duration and date sent/received.

3.2.2. Cookies

We use cookies to uniquely understand how our Services are being used, customize our Services for you and improve your experience.

Cookies refers to small pieces of information that a website sends to your computer's hard drive while you are viewing the site. Web beacons are electronic images that may be used in our Services or emails and help deliver cookies, count visits, and understand usage and campaign effectiveness.

3.2.3. Usage and Log Information

We collect information about your activity on our Services, including and not limited to service-related, diagnostic, and performance, including how you use our Services, your settings, interactions with other users, and the time, frequency, and duration of your activities. We gather log files, diagnostic and crash reports.

3.2.4. Transaction and Experience Information

When you use our Services or access our Sites, we collect your personal data in order to offer you that service.

For our unbranded payment services, your interaction is with the merchant, on their platform, we collect personal data when you are interacting with and making payments to merchants, on their sites and checkout with PesaWay without logging into an account. This information includes without limitation; payment information, device information, technical usage data and location, we use this information to process the transaction, prevent fraud and comply with the laws & regulations.

3.2.5. Third-Party Information

PesaWay works with third-party service providers to help us operate, provide, improve, understand, customize, support, and market our Services. These companies may provide us information about you in certain circumstances; for example, app stores may provide us reports to help us diagnose and fix service issues.

4. Use of Personal Data

We are committed to ensure that your personal information is processed in a way that is compatible with the specified, explicit, and legitimate purpose of collection which includes and not limited to:

  1. Verifying your identity information through publicly available and/or restricted government databases to comply with applicable Know Your Customer/Business (KYC & KYB) requirements.
  2. Assessing the purpose and nature of your business or principal activity, your financial status and the capacity in which you are entering into the business relationship with us.
  3. Communicate with and keep you informed about the products and/or services, events, and other news and information we believe would interest you or that you applied for.
  4. To perform our obligations under a contractual arrangement with you including processing and settling transactions.
  5. To detect, prevent and report theft, money laundering, terrorist financing, corruption or other potentially illegal activity, or activity that could lead to loss.
  6. Any purpose related to the prevention of financial crime, including sanctions screening, monitoring of anti-money laundering and any financing of terrorist activities.
  7. Receive and respond to your submissions on the Services such as submissions on PesaWay website, web applications and mobile applications, social media and submissions to Customer Service Contacts.
  8. To conduct research and analysis; Monitor and analyse trends, usage, and activities in connection with our Services.
  9. PesaWay may process your personal information to protect the interests of its clients, shareholders, employees and other third parties, including our business partners and members of the public.
  10. Develop new products and services and enhance current products and services.
  11. Design, develop, and test products, services, and solutions for clients, which may involve integrating various sources and types of your personal information across multiple legal entities and jurisdictions, in accordance with applicable laws.
  12. Comply with a law, regulation or any legal obligation.
  13. For employment purpose including and not limited to screening & background checks.
  14. For employees including contractors, we create an employment record/data to facilitate continuous monitoring during your employment with us.
  15. For security purposes when using our WIFI and or visiting our offices.
  16. Where you attend an event sponsored by PesaWay, we will be taking photos or videos of the event. These images or videos will be used by us to share news about the event, and may be used in press releases, printed publicly, and published on our website.
  17. To support our audit and corporate governance function.
  18. Carry out any other purpose described to you at the time of collecting information.

4.1. Sharing & Transfer of Your Personal Data

As a pan-African organization leveraging cloud-based systems, PesaWay may process or access your personal data in the country where you use our services or in other jurisdictions where we operate. When transferring data across borders, PesaWay implements safeguards such as contractual clauses, compliance frameworks, or binding corporate rules to ensure processing aligns with this Privacy Policy and applicable legal requirements.

All of our rights and obligations under our Privacy statement are freely assignable by us to any of our affiliates, including and not limited to, a merger, acquisition, restructuring, or sale of assets, or by operation of law in such circumstances we may transfer your information to affiliates, successor entities, new owner or other relevant third parties as per the transaction or transition.

4.2. Direct Marketing

We may wish to send you marketing messages and shall request your consent to receive such messages. However, you may at any time opt out of receiving marketing messages from us by using the opt-out option or by contacting us using any of our channels available on our website or visiting our offices.

5. Protection of Children's Information

PesaWay's services and digital platforms are designed for individuals aged 18 years and above.

We do not knowingly collect, use, or retain personal information from children. If we become aware that such data has been inadvertently collected, we will take steps to delete it promptly unless legally obligated to retain it.

6. Your Rights

You have the right to access, rectify, update, delete and erase your information held with us, the right to restrict and object to certain processing of your information. This includes the right to object/opt out to our processing of your information for direct marketing and the right to object to our processing of your information where we are performing a task in the public interest or pursuing our legitimate interests or those of a third party. Data portability – you have a right to request us to send a copy of your personal data to another organisation.

7. Retention of Personal Data

PesaWay retains your personal data only for as long as necessary to fulfil the purposes for which it was collected or as mandated by applicable laws and regulations.

Notwithstanding that the retention period determined above may have lapsed, we may continue to retain your personal data, if it is relevant to a pending complaint or dispute or query or potential legal process/compliance (to meet obligations under tax, anti-fraud, financial, or other regulatory requirements).

Once retention is no longer necessary, we will securely delete, destroy or anonymize your data.

PesaWay shall update this privacy statement periodically to reflect changes in our practices or legal requirements. The most current version will always be available on our website.

Updates will take effect immediately upon being posted. Where required by law, we shall notify you directly of significant changes.
